Terms and Conditions of Advertising and Sale Market Access Promotions, Inc. doing business as Vacation Tour & Cruise is located at PO Box 290816, Tampa, FL 33687 USA. We are a licensed travel agency in Hillsborough County and Temple Terrace, Florida. We are registered with the State of Florida as a Seller of Travel. Registration #10098. All advertised prices are subject to change at any time. As a travel agency, we will get a quote from a vendor and transmit the quote via various means to clients but the price is valid for that moment in time unless paid for in full. When you are ready to pay for the travel services, we will advise you if your particular transaction requires a deposit or full payment and all cancellation penalties of the transaction. Please understand both the price and the terms as most travel components have penalties for changes and a lot of them are instant purchase/fully nonrefundable. Most airline tickets have a $100 to $300 change fee on top of any fare increase in the ticket for any changes once made. It is the client responsibility to provide the agent with a legal name spelling according to the picture ID that will be used. The Client will be provided with a confirmation and it is again the client responsibility to read the confirmation and make sure it matches the picture ID that will be used. All international flights will require a passport book for US Citizens. Clients are offered the option of paying for travel insurance which usually runs 7-12% of the transaction and will be provided by a travel insurance company that is licensed for your state. Travel insurance does pay cancellation penalties if they are for a “covered” reason which includes medical problems, casualty of your dwelling, jury duty, automobile problems on the way to the port of departure, military orders, court summons, etc. It costs an extra fee to cover business reasons or get any reason coverage. We do also sell “vendor” insurance which may be less expensive but be comprised of a cancellation waiver coupled with a minimal insurance back-up that begins when you depart. Many of these charge a fee or refund the balances in future travel certificates that have to be used in one to two years. Many US medical insurance plans may have little or zero coverage in foreign countries. Medicare is not valid overseas but various Medicare supplements may have coverage. We advise clients to speak with their health insurance company prior to overseas travel and discuss travel insurance coverage with our agents. IF YOU DECLINE INSURANCE, YOU CAN LOSE ALL OR PART OF YOUR MONEY IF YOU CANCEL THE TRANSACTION. PENALTIES INCREASE AS YOU GET CLOSER TO YOUR TRAVEL DATE AND MANY OF THE BEST RATES ARE INSTANT PURCHASE AND FULLY NONREFUNDABLE. All advertised prices are double occupancy and may be plus tax, mandatory gratuities and/or a resort fee. All advertised airfare prices that are quoted include all tax according to the department of transportation rules. We do add an airline booking fee that will be quoted separately when ticketing services are provided. Airlines pay no commission so we only issue tickets to our customers who are buying hotel, cruise or tour services. Airlines charge seat fees, baggage fees and other assorted fees. You will be quoted those at time of sale and our ticketing fee includes a seat assignment (where permitted) and the mandatory entry of TSA inforation into the record. We also handle any airline initiated flight changes without an additional fee. Purchaser agrees that the travel agency is acting as buyer’s agent with travel component vendors including airlines, hotels, tour companies and cruise lines on a best efforts basis. The client agrees and gives permission for our agents to accept all vendor contracts on your behalf so you will be subject also to the terms and conditions of those contracts when trying to settle a dispute. Many of those companies are not subject to US law and may be incorporated in foreign countries. If you are looking at a particular travel product, we encourage you to touch on the terms and conditions in that product’s website to see the actual contract language. We can always provide that to you and many email confirmations have links to those terms and conditions. When you travel, some disputes are best handled at the time. We advise the client speak to management if they are ever unhappy with travel services as they may be able to correct the problem. Most of our vouchers have emergency numbers on them and vendors require you call for a resolution if you intend on filing a claim post travel. We also suggest you call us if you have a problem with a booking. We are unable to fix a problem that we don’t know about. We also are fond of saying the less you pay, the more of an adventure travel is. If you have booked the least expensive category, then an upgrade may require payment of additional funds. In the event of hotel oversell or other overbooking the vendor is required to provide equal level of hotel accommodations. Airlines are required to pay you when they overbook aircraft. Acts of God, governments, unions, political unrest or war are not the responsibility of the travel agency or our vendors. In the event of a problem, we will all act on a best efforts basis, given available resources and inventory to move you to your intended destination. Insurance will reimburse some added costs for trip interruption when they happen but they are fully the responsibility of each individual passenger. We do not actually provide the services in question so the customer agrees that disputes must be submitted to our vendors with an allowed time for response. Most of our hotel, cruise and tour vendors will address a legitimate complaint. If we have used your credit card to purchase airline tickets, you agree not to charge back any airline transaction, regardless of a service problem. You agree to follow the complaint resolution process with the airline and accept the outcome of that process. As a condition of airline ticket issuance, you personally agree to indemnify and reimburse our travel agency, if we receive any type of charge back to the agency on any type of airline transaction. We do require all customers establish positive identity including a verifiable street address for any type of credit card transaction. We reserve the right to refuse credit card transactions in any instance where we cannot establish positive identity and location. All credit card transactions will require a CVV and a street address match to be processed. The name on the credit card must match the identity document of at least one of the passengers as we do accept 3 rd party credit cards in any instance. Please be expected to have to provide identity documents by email or fax to complete a prepaid transaction with our company. Purchaser also agrees all final disputes with the travel agency will be negotiated by binding arbitration. Parties agree that the venue for this transaction is Hillsborough County Florida. Vendor terms and conditions may name a different procedure and different venue (including a foreign country) for actions taken under the various travel contracts and you agree that all transactions are subject to those various travel contracts.
